Cowboy Builders......

Cowboy builders are the bane of the construction industry.
There are, on average, at least 100,000 complaints every year about them. They ruin things for perfectly reputable builders, and for all the talk about them, they’re in the minority – it just happens to be a minority that gets a lot of publicity.

Cowboy builders are simply rogue traders, of course, often with little or no knowledge of building, so you end up with a botched job – that’s if it’s finished at all.

Protecting Yourself From Cowboy Builders

The best thing is to learn to spot the cowboy builders early, so you can turn them away – it saves a lot of trouble later. The first tip-off is if they asked to be paid in cash, or cash-in-hand all with a promise on no VAT to be paid. No legitimate business will work off the books like that.

If they say a contract isn’t necessary, watch out – it’s vital in a business transaction like this, and without it, your legal position is nowhere near as strong. Most rogue builders don’t carry insurance, either, which again could work to your detriment if an accident occurred.

Are they willing to provide a written estimate and costings for the job, as well as a time frame for each stage of the work? A proper tradesman would, quite gladly. Where they do offer a quote, it could be unusually low, and they might offer to begin work immediately.

Do they have references? Do they have premises and a landline number, or simply a van and a mobile?

All of the above should raise red flags. You can protect yourself by having everything in writing and ask for a guarantee. Check references, talk to the people who’ve had the work done, and look at the work if possible. Ask your family and your friends for recommendations. Get several estimates and remember, cheapest isn’t always a savings.

It’s a help, too, if the builders and members of some trade group – although check that as well, since cowboy building firms have been known to fake membership. Finally, never pay in cash, and certainly never upfront – you should only pay for work that’s been completed.

What To Do If You’re A Victim Of A Cowboy Builder

Sometimes, though, the cowboys do win, and the building work is a shambles. What should have been wonderful construction work is a mess, and the builders have moved on. What can you do?

What they’ve done constitutes fraud, so you should complain to the police, giving them as much information on the builder as possible. Also complain to Trading Standards, which takes a very harsh view of rogue traders.

If you can track down the cowboy builder and he refuses to refund your money, take him to court. In the event of a small job, small claims court will likely suffice, and won’t cost you much. In the event of a big job, though, you will be looking at some hefty legal bills. Either way, it’s a lot of problems, and you still need to employ a proper builder to do the work correctly. The best solution, always, is to take the time and find someone who’ll do it right the first time.

Getting quotes from your local trades

At some point, it is inevitable that we will need a service offered by a local tradesperson, so how do we go about acquiring this service?

Word of mouth?
Directory?
Online directory?
Local Press?
Radio advert?
Flyer through the door?
Knock on the door?

Well, we all know a knock on the door is a massive no, no! This is indeed the favourite for your local rogue traders - or cowboys if you like, this can also go for the flyer through the door, but not always, this is a valid advertising medium used by local tradespeople.

You have five options, all of which are possibilities, but surely, if they have the money, but not the skills, they could be everywhere, couldn’t they?

Word of mouth is a popular way for tradespeople to receive ongoing work, but is your friend qualified to know that the work is up to standard? Is your friend aware that all materials used are appropriate for the job done? Would your friend know whether the tradesperson has cut corners?

What can you do to ensure you are getting exactly what you are expecting?

Firstly, ensure YOU double check any memberships to any organisations that they are claiming to be apart of, remember, if relevant, it is no longer Corgi, it is now the Gas Safety Register.

No matter how you find your tradesperson, ask them, and don’t be shy as this will save any disappointment further down the track, “can I have everything written down?”

A written agreement of what IS and what IS NOT included in your quote is very important.

What deposit do they require, if any?
What hours do they work?
How much are the materials for this project?
How much is labour for this project?
How long will this project take?
Are you, as the business owner partaking in work and/or overseeing this project?
Do you offer a guarantee, if so, how long?

So you see, no matter what your questions, it is your right to ask.

This will need to be done with every single quote you acquire, three to five quotes should be your aim, you need to keep your options open, and this is YOUR project, so take your time.

If the tradesperson doesn’t turn up, don’t think “two quotes will do”, find another local tradesperson, DO NOT call this tradesperson again, first impressions count, if they cannot be bothered to even turn up to quote you as agreed, then do not chase them, this could be a sign of things to come, but at a later date, they could be holding your money!

The cheapest quote is not always the best! By following the advice above, take an informed decision of who is offering what for the quote in question, it may well be the dearest, but as the saying goes, you will only get what you paid for!

HSE launch 'Asbestos: The Hidden Killer' campaign

Health and Safety Executive's Asbestos:The Hidden Killer campaign aims to reduce the rising death rate by educating today's tradesmen about the danger that asbestos presents to them

Figures issued by the Health and Safety Executive revealed that every week 20 tradesmen die from asbestos-related diseases, and this number is set to increase.

Former tradesman and England and Arsenal footballing legend, Ian Wright, has given his support to help highlight the importance of the Health and Safety Executive's (HSE) Asbestos:The Hidden Killer campaign which is running throughout October and November and aims to reduce the rising death rate by educating today's tradesmen about the danger that asbestos presents to them.

Ian Wright was shocked when he learnt that 20 tradesmen a week were dying from having been exposed to asbestos in their working lives.

"I used to be a plasterer before becoming a professional footballer, and was really surprised to learn that the number of deaths is actually on the increase year on year".

"If that was footballers dying, the whole of the premiership would be wiped out in just three months".

Steve Coldrick, Director of the HSE's Disease Reduction Programme says, "We need to educate tradesmen about how asbestos and its dangers are relevant to them".

"We want them to change the way they work so that they don't put their lives at risk"".

"I can really relate to the situations tradesmen find themselves in and urge them to take care," added campaign ambassador, Ian Wright.

Steve Coldrick explained why a major campaign has been launched to raise awareness of the real risk that tradesmen face, "Exposure to asbestos is the biggest single cause of work-related deaths, with around 4,000 people a year dying from asbestos-related disease".

"The overall number of deaths is rising because a large number of workers who have already been exposed to asbestos dust around 40 years ago will go on to develop mesothelioma, a terminal cancer or other asbestos related diseases".

1,000 (25%) of the 4,000 now dying each year are tradesmen and while the number of deaths in traditional industries has plateaued, deaths in trades continue to rise".

"The HSE campaign is vital because research shows that only one in ten tradesmen know that exposure to asbestos can prove fatal" says Jill Morrell, Head of Public Affairs at the British Lung Foundation".

"The asbestos-related cancer mesothelioma is a cruel disease which as yet has no cure".

"We must do all we can to prevent more people dying from this preventable disease".

Many workers, particularly tradesmen, think that they are not personally at risk of exposure to asbestos and the diseases it can cause.

They think that since asbestos was banned many years ago, the problem has been dealt with and therefore it is not relevant to them.

The reality is very different.

Even today asbestos presents a real and relevant risk to plumbers, joiners, electricians and many other maintenance workers.

Asbestos may be present in any building constructed or refurbished before the year 2000, and it is estimated that around 500,000 non-domestic buildings could contain asbestos.

These buildings all need repair and maintenance work from time to time and when the asbestos fibres are disturbed e.g by drilling or cutting, they are likely to be inhaled as a deadly dust.

If asbestos-containing material is in good condition and in a position where it cannot be disturbed or damaged, it is safer to leave it where it is and ensure that the risks are managed.

Those responsible for managing building maintenance and repair of non-domestic buildings, have a duty to inform tradesmen if asbestos is present in a building they are working in.

Depending on the type of asbestos-containing material, and providing they have been trained and the proper controls are in place, they may be able to work on the project.

Asbestos sprayed coatings, board or lagging on pipes and boilers - should only be tackled by licensed workers.

Posters and radio adverts will encourage tradesmen to get a free asbestos information pack by calling 0845 345 0055 or by visiting the website for further information.

The free information pack provides information on the dangers of asbestos, highlighting where asbestos-containing materials may be present in buildings, what they look like, how they should be dealt with and where to find training.

From 1 October 2008 new rules will apply to paving over your front garden.

Elsewhere around your house there are no restrictions on the area of land which you can cover with hard surfaces at, or near, ground level.

However, significant works of embanking or terracing to support a hard surface might need a planning application.

If you live in a listed building, you will need listed building consent for any significant works whether internal or external.

Building Regulations
Generally a new driveway or patio area does not require building regulations approval.

However, you will need to make sure that any alterations do not make access to the dwelling any less satisfactory than it was before. So, for example, changing levels to introduce steps where none existed before would be a contravention of the regulations.

Cold callers may use these lines to frighten homeowners into doing business with them

"You have loose tiles on your roof"
"Your roof has been leaking"
"I see cracked brickwork on your house"
"You need to have some pointing on your chimney"
"You need some work doing on your driveway"
"I'm doing some work in the area and have materials left over which we need to use up"
"I'm doing some work for the council down the road"
"I'm doing free property surveys to check if you have any rising damp"
"Your brickwork is acting like a sponge soaking up the rainwater" (Ignore this popular line as bricks are supposed to behave like this!!)

These are the things cold callers will say need doing

Roofing repairs
Gardening services, tree surgery
Path or driveway work
Block paving or tarmac driveways
Damp proofing
General maintenance work
Guttering repairs
Fascia boarding repairs
Wall surface coatings

How do I get rid of these rogues?

Do not engage in conversation with them
Say you do not buy goods and services at the door
Say you need to compare prices
Say you have to discuss it with your partner, son, daughter or friend

In the case of the elderly, particularly those living alone, it is well worth thinking about having a son or daughter authorised as a joint signatory on bank accounts for amounts over, say £200.

If you think your house needs work, then these are the steps you should take.

Never EVER employ a cold caller

Always use a professional builder who is recommended for doing similar work or a bona fide member of a trade association, see the list below. Alternatively you can submit online free to get quotes from a pre-vetted tradesperson and then rate and recommend them afterwards.

Talk to the builder's previous customers. Go and see the jobs they have done and make sure the customers were happy. Check they completed the job properly and came within/on budget.

Produce a detailed written specification for the work you want done.

Ask at least three builders to provide written quotes.

Make sure the builders' quotes cover everything you would like done, including the supply of materials, removal of rubbish and making good after the work is finished.

Builders 'Ripped Off' By Taxman

Builders can get a rough ride sometimes being portrayed as modern day cowboys and rip-off merchants. The truth is that they may be 'ripped off' by the taxman. A significant number can get tax refunds but are missing out. It is not small change either. The average refund is over £1000.

Why don't they know about it? Many people believe the Government will refund overpaid tax. Sadly, this is not true and it is an individual's responsibility to claim their tax back.

The refund applies to the self-employed. Anyone working on the 'CIS' (Construction Industry Scheme) is classed as self-employed, but unlike every other self employed person in the country their income is taxed at source when paid to them by contractors. It is then their responsibility to submit a tax return to claim back any overpayment and to include the cost of expenses such as running a van, mobile phones, etc. And guess what, the taxman has made it so complicated that hundreds of thousands of sub-contractors don't do it.

How much is it worth? According to Refunds Direct, a tax refund company, the average refund is £1000 but can run into the thousands, especially where a claim can cover each of the last six years – the limit for back-dating claims.

Builders have had rotten press recently. With TV shows and celebrities giving them a bad name, the truth is, for every cowboy, there are plenty of professional builders who offer great service. And it's up to you as 'project manager' - for in most cases, that's what you are - to ensure that you get the results you want. Here's some do's and don'ts to guide you:
DO...
....Check them out
Before you begin, ask potential builders for references from previous customers, ask to visit a previous job and see his workmanship.
A good builder will provide you with credentials and references, so try to visit previous jobs similar to your own. If the builder is a member of a trade association, what does this mean? If they claim to be a member, check to ensure that they really are member. An impressive-looking logo won't repair a leaking new roof! Find out more about their credentials before going ahead.
....Get it in writing
Clarity is the key and a contract drawn up before work begins is essential.
Agree on the timetable, any changes agreed throughout the job should be put in writing
....Know your regulations
